Course and Coaching Services Waiver and Agreement
This Service Agreement & Waiver (“Agreement") is entered into by and between the client who’s name is printed and signed on this agreement ("Client") and Kori McClurg Transformational Wellness, LLC, ("Health Coach"), collectively referred to as the "Parties." By signing this Agreement, the Client acknowledges and agrees to the following terms and conditions regarding the provision of health coaching services.
1. Nature of Health Coaching Services
Health coaching services provided by Kori McClurg Transformational Wellness are designed to support the Client in achieving personal health and wellness goals through lifestyle, behavior, and nutrition recommendations. The Health Coach is not a licensed medical professional, therapist, or counselor, and the services provided are not intended to diagnose, treat, or cure any medical or psychological conditions.
2. Client's Responsibilities
The Client agrees to provide accurate information regarding their health history, medical conditions, lifestyle habits, and any other relevant information to the best of their knowledge. The Client acknowledges that their full participation and engagement in the coaching process are crucial for the effectiveness of the services.
3. Medical Disclaimer
The Client understands and agrees that the Health Coach is not a medical doctor, licensed nutritionist, or therapist and that the information and advice provided are for educational and informational purposes only. Health coaching services are not intended to replace the advice or care of any medical professional. The Client is encouraged to consult with a healthcare provider before making any significant changes to their diet, exercise routine, or lifestyle, especially if they have any pre-existing medical conditions or concerns.
4. Confidentiality
The Health Coach will maintain the confidentiality of all personal and health-related information provided by the Client, except as required by law or when the Client provides written consent for disclosure. The Health Coach may share general, non-identifiable information with others for educational or promotional purposes, but any information shared will not include personal or identifiable details.
5. Assumption of Risk
The Client acknowledges that there may be inherent risks involved in following health coaching recommendations related to physical activity, dietary changes, and other lifestyle modifications. By agreeing to participate in health coaching services, the Client assumes full responsibility for any risks, injuries, or adverse effects that may arise as a result of their participation in these activities.
6. Waiver of Liability
To the fullest extent permitted by law, the Client agrees to release, waive, and hold harmless the Health Coach, their affiliates, employees, agents, and contractors from any and all claims, liabilities, damages, or expenses arising out of or in any way connected with the Client's participation in health coaching services. This includes but is not limited to any injuries, health complications, or losses incurred as a result of following the Health Coach’s guidance.
7. Payment and Cancellation Policy
The Client agrees to pay for health coaching services as outlined in the service agreement or pricing schedule. Payments must be made prior to or at the time of service.
8. Money-Back Guarantee Policy
We want you to be completely satisfied with your purchase of Brain+Body: Your Own Way. Our goal is to provide you with valuable learning experiences and to help you achieve your desired outcomes. If you are not fully satisfied with the course, we offer a money-back guarantee under the following terms:
8.1. Eligibility for Refund
To qualify for a refund, you must meet the following criteria:
1. You must request the refund within 14 calendar days from the course end date.
2. You must have completed 100% of the course content.
3. You must demonstrate that you have completed the daily course exercises.
4. You
must submit your refund request via email to [email protected] and
include the reason for your dissatisfaction with the course.
8.2. Refund Process
All refund requests must be submitted within the specified time frame mentioned above.
After accepting your refund request, we will process your refund within 10 business days from the date of receipt.
Refunds will be issued to the original payment method used at the time of purchase.
8.3. Exceptions
The following are not eligible for a refund:
If you have violated any of our terms of service or engaged in fraudulent behavior (such as requesting multiple refunds).
8.4. Non-Refundable Fees
Any processing fees or taxes that were charged at the time of purchase are non-refundable.
8.5. Course Modifications
